1. Introduction Welcome to Fansclout! These Terms of Service ("Terms") govern your use of Fansclout, operated by Creativaultz Business Solution Pvt Ltd, owned by MindMatrix Corporate Pvt Ltd, located at Anexartisias 187, Limassol 3040, Cyprus. By accessing or using our platform, you agree to be bound by these Terms.

2. Definitions

   • "Content" refers to any text, images, videos, and other materials posted or uploaded by users.
   • "User" means any individual or entity who accesses or uses our services.
   • "Platform" refers to the Fansclout website and any related services.

3. Eligibility You must be at least 18 years old to use our services. By using our platform, you represent and warrant that you meet this age requirement.

4. Account Registration To use certain features, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

5. User Responsibilities

   • Compliance: You agree to comply with all applicable laws, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
   • Content: You are responsible for all Content that you post, upload, or otherwise make available through our platform. You must not post any Content that is illegal, harmful, offensive, or infringes on any third-party rights.

6. Prohibited Activities You agree not to:

   • Use the platform for any illegal purpose.
   • Post or transmit any Content that is defamatory, obscene, pornographic, or otherwise offensive.
   • Engage in any activity that interferes with or disrupts the platform.

7. Intellectual Property Rights All intellectual property rights in the platform and the Content provided by Fansclout remain the property of Creativaultz Business Solution Pvt Ltd. Users retain ownership of the Content they upload but grant Fansclout a worldwide, non-exclusive, royalty-free license to use, distribute, and display such Content.

8. Privacy Policy Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Payment and Refund Policy

   • Subscriptions: Certain features of the platform may be available through a subscription model. Details of the subscription plans and associated fees will be provided on the platform.
   • Refunds: Subscription fees are non-refundable, except as required by applicable law.

10. Payment Processing

    • Third-Party Payment Processors: We use third-party payment processors to handle payment transactions. By using our services, you agree to the processing of your payments through these third-party processors. Your payment information is handled in accordance with the privacy policies of these processors.
    • Payment Gateway: When you make a payment, you will be redirected to a third-party payment gateway. Fansclout does not store any payment information, and any issues related to payment processing should be addressed to the respective payment processor.
    • Fees: All fees are in Indian Rupees (INR) and are exclusive of all taxes, levies, or duties imposed by taxing authorities. You are responsible for payment of all such taxes, levies, or duties.
    • Payment Methods: We accept various payment methods, including credit cards or Bank Transfer or UPI and other electronic payment methods as specified on our platform.
    • Authorization: By providing payment information, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third-party payment processor) to charge your payment method for the total amount of your subscription or other fees.
    • Payment Issues: If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, we may suspend or cancel your access to the services until payment is successfully processed.

11. Payments to Creators

    • Payment Schedule: Creators will receive payments on a weekly basis. The earnings will be calculated based on the content views, subscriptions, and any other monetized activity as specified on the platform.
    • Minimum Payout Threshold: Payments will be made once the minimum payout threshold is reached, which will be specified on the platform.
    • Payment Methods: Payments will be made through the payment methods specified on the platform, and creators may need to provide necessary payment information to facilitate the transactions.
    • Taxes: Creators are responsible for reporting and paying any applicable taxes on their earnings as per their local regulations.

12. Limitation of Liability To the fullest extent permitted by law, Fansclout shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

    • Your access to or use of or inability to access or use the platform.
    • Any conduct or content of any third party on the platform.
    • Any content posted by users, including but not limited to, any illegal, offensive, or inappropriate content.
    • Fansclout's aggregate liability for all claims arising out of or related to the service is limited to the amount paid by you, if any, to use the service.

13. User Obligations and Conduct Users agree to:

    • Maintain Security: Keep their account details secure and confidential.
    • Respect Others: Do not harass, abuse, or harm other users.
    • Legal Compliance: Comply with all applicable laws and regulations.
    • Content Standards: Ensure that all content posted complies with community guidelines and does not contain illegal or prohibited materials.
    • Report Violations: Immediately report any violations of these Terms or illegal content to Fansclout.

14. Governing Law These Terms are governed by and construed in accordance with the laws of Cyprus, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Cyprus.

15. Changes to the Terms We reserve the right to modify these Terms at any time. We will provide notice of changes by posting the new Terms on our platform. Your continued use of the platform after any such changes constitutes your acceptance of the new Terms.
